Principal Charity Classic Mobile Application Terms and Conditions

These Mobile App Terms and Conditions (“Terms”) govern your access to and use of the Principal Charity Classic mobile application (the “PCC App”), made available by the Golf Charitable Foundation of Greater Des Moines d/b/a Principal Charity Classic (“PCC,” “we,” “us,” or “our”). By downloading, installing, accessing, or using the PCC App, you agree to be bound by these Terms. If you do not agree, do not use the PCC App. This PCC App relates to the Principal Charity Classic event and may provide tournament-related content, including weather, maps, golfer tracking, schedule information, links to third-party sites and PCC Apps, and user feedback functions.

  1. Agreement Between You and PCC; Not Apple

These Terms are a legal agreement between you and us only, and not with Apple, Inc. (“Apple”). We, and not Apple, are solely responsible for the PCC App and its content, except as otherwise expressly provided herein. If there is any conflict between these Terms and Apple’s applicable App Store rules or terms of service, Apple’s applicable rules will control solely to the extent required. Apple is a third-party beneficiary of these Terms and may enforce these Terms against you as a third-party beneficiary.

  1. Eligibility and Acceptance

You represent that you are legally able to enter into these Terms. If you are using the PCC App on behalf of a company or other organization, you represent you have authority to bind that entity to these Terms. By using the PCC App, you also agree to comply with all applicable laws, rules, and regulations.

  1. License Grant and PCC App Use

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the PCC App on Apple-branded devices that you own or control, solely for your personal, non-commercial use and as permitted under Apple’s usage rules. The PCC App is licensed, not sold, to you. We reserve all rights not expressly granted to you.

During your use of the PCC App you may not:

  • copy, modify, adapt, translate, distribute, sublicense, rent, lease, lend, sell, or otherwise exploit the PCC App except as expressly permitted by these Terms or applicable law;
  • reverse engineer, decompile, disassemble, or attempt to derive source code from the PCC App, except to the extent such restriction is prohibited by law;
  • use the PCC App in any unlawful manner or in a manner that could damage, disable, overburden, or impair the PCC App or related systems;
  • use content made available through the PCC App for commercial or promotional purposes without our prior written consent.
  1. Event Information; No Guarantee of Accuracy

The PCC App may display event-related information, including schedules, pairings, weather, course maps, venue information, transportation information, player locations, scoring, statistics, hospitality information, and other tournament content. Such information may change at any time and may not always be complete, current, or error-free. Tournament dates, times, pairings, and availability are subject to change, delay, suspension, or cancellation without notice. We do not guarantee that information presented in the PCC App is accurate, complete, or available at all times.

  1. Weather Functionality

The PCC App may provide weather forecasts, alerts, radar, or related information for user convenience. Weather information is informational only, may come from third-party providers, and must not be relied on as a sole source for safety-related decisions. Actual weather conditions may differ from forecasts, and alerts may be delayed, interrupted, or unavailable. You are solely responsible for your own safety and for monitoring official event communications, onsite announcements, and local conditions. We disclaim liability for decisions made based on weather information made available through the PCC App.

  1. Golfer Tracking; Scoring; Third-Party Data

The PCC App may include golfer-tracking, scoring, shot trails, player-position information, or similar features derived from or powered by ShotLink or other PGA TOUR-related data feeds.

All scoring, tracking, and player-location information is provided for convenience and entertainment purposes only and may be delayed, estimated, incomplete, interrupted, corrected, or unavailable. We do not guarantee the accuracy, completeness, or real-time availability of any golfer-tracking or scoring information. You agree not to scrape, reproduce, redistribute, commercially exploit, create derivative data products from, or otherwise misuse any such data except as expressly permitted by us and the applicable rights holder.

  1. Third-Party Websites and Third-Party Mobile Applications

The PCC App may contain links to third-party websites, services, ticketing platforms, sponsor sites, charitable partner sites, social media platforms, lodging or transportation services, streaming services, or third-party mobile applications. These third-party offerings are not under our control, and we are not responsible for their content, functionality, policies, terms, privacy practices, products, services, availability, or security. When you leave the PCC App or launch a third-party mobile application, your use is governed by that third party’s own terms and privacy policy, not ours.

Your dealings with third parties are solely between you and the third party. We do not endorse, warrant, or assume responsibility for any third-party site, app, advertisement, product, service, or content linked from the PCC App.

  1. Apple Maps and Location-Based Features

The PCC App may integrate with Apple Maps, MapKit, or related Apple mapping/location services to provide directions, venue maps, parking guidance, points of interest, navigation assistance, or similar functions. Apple Maps and related mapping content are subject to Apple’s terms, conditions, notices, and restrictions, and your use of those services must comply with Apple’s applicable terms. Apple’s maps services are licensed on a non-exclusive, revocable basis and are subject to restrictions on misuse, extraction, scraping, alteration of notices, and unauthorized redistribution.

Location-based features may require you to enable device permissions. If you deny location permissions, some PCC App features may not function properly. Directions, route guidance, travel times, and map content are provided for convenience only and may be inaccurate, incomplete, or unavailable. You are solely responsible for safe travel, obeying traffic laws, and exercising independent judgment when using any maps or directions.

  1. Feedback and User Submissions

The PCC App may provide a “feedback,” “contact us,” “support,” or similar feature allowing you to submit comments, questions, ideas, or suggestions (“Feedback”). By submitting Feedback, you grant us a worldwide, perpetual, irrevocable, sublicensable, transferable, royalty-free right to use, reproduce, modify, adapt, publish, translate, distribute, display, and otherwise exploit that Feedback for any lawful purpose, without compensation, acknowledgment, or obligation to you, except to the extent prohibited by law. If you do not want Feedback used in this way, do not submit it.

You agree not to submit Feedback that is unlawful, defamatory, infringing, confidential, deceptive, or harmful, or that contains malware, spam, or unauthorized personal information of others.

  1. Intellectual Property

The PCC App, including its software, design, text, graphics, interfaces, logos, audio, video, photos, event information, tournament content, and compilation of content, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license expressly granted above, no right, title, or interest in or to the PCC App or its content is transferred to you.

You may use PCC App content solely for your personal, non-commercial use. You may not reproduce, publicly display, perform, distribute, create derivative works from, republish, transmit, or otherwise exploit PCC App content without prior written permission, except as allowed by applicable law.

  1. Third-Party Trademarks Used with Permission

The PCC App may display the names, logos, marks, trade names, service marks, and other brand features of sponsors, the PGA TOUR, ShotLink, Apple Maps, charitable partners, broadcasters, vendors, and other third parties. Such marks are the property of their respective owners and are used by us with permission, under license, or as otherwise legally authorized. Nothing in the PCC App or these Terms grants you any right or license to use such marks. You may not copy, display, frame, reproduce, or use any third-party mark without the applicable owner’s prior written consent.

  1. Privacy

Your use of the PCC App is also subject to our Privacy Policy which can be found at https://principalcharityclassic.com/privacy-notice/, which describes how we may collect, use, and share information in connection with the PCC App. By using the PCC App, you acknowledge that relevant technical and device information may be processed to operate, maintain, and improve the PCC App.

  1. Push Notifications and Device Features

If enabled, the PCC App may send push notifications relating to weather, event updates, schedules, traffic, parking, ticketing, featured content, or other tournament-related alerts. Delivery of push notifications depends on third-party platform services and device settings, and we do not guarantee delivery, timeliness, or accuracy. You can manage notification preferences through your device settings and, where available, within the PCC App.

  1. Assumption of Risk Related to Event Attendance

To the extent the PCC App is used in connection with in-person attendance at the tournament or related events, you acknowledge that attendance at a golf event involves inherent risks, including risks associated with weather, crowds, uneven terrain, moving golf balls, player activity, and other conditions. The PCC ticket disclaimer expressly allocates risk for tournament attendance, including injury, illness, loss of property, and other hazards. These Terms do not replace any separate ticket terms, venue rules, onsite policies, waivers, or event disclaimers, all of which continue to apply.

  1. Disclaimers

THE PCC APP AND ALL CONTENT, FEATURES, FUNCTIONALITY, DATA, WEATHER INFORMATION, MAP INFORMATION, GOLFER-TRACKING INFORMATION, THIRD-PARTY LINKS, AND RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, OR THAT THE PCC APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

WITHOUT LIMITING THE FOREGOING, WE MAKE NO WARRANTY THAT:

  • WEATHER, SCORING, LOCATION, OR PLAYER-TRACKING DATA WILL BE ACCURATE OR REAL-TIME;
  • THIRD-PARTY APPS OR LINKS WILL BE AVAILABLE OR SAFE;
  • APPLE MAPS OR ROUTING INFORMATION WILL BE COMPLETE, CURRENT, OR SUITABLE FOR ANY PARTICULAR PURPOSE; OR
  • THE PCC APP WILL MEET YOUR REQUIREMENTS.
  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR AFFILIATES, LICENSORS, SPONSORS, TOURNAMENT PARTNERS, SERVICE PROVIDERS, CHARITABLE PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, VOLUNTEERS, CONTRACTORS, AND DESIGNEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATED TO THE PCC APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PCC APP SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, FOR THE PCC APP.

  1. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless us and our affiliates, licensors, sponsors, service providers, and related parties from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees arising out of or relating to: (a) your use of the PCC App; (b) your violation of these Terms; (c) your violation of any law or rights of any third party; or (d) your misuse of third-party data, content, maps, APIs, trademarks, or linked services.

  1. Maintenance and Support

We, and not Apple, are solely responsible for providing any maintenance and support services for the PCC App, if any, as required under applicable law or as otherwise stated by us. Apple has no obligation whatsoever to furnish maintenance or support services with respect to the PCC App.

  1. Product Claims; Warranty Claims; Intellectual Property Claims

We, and not Apple, are responsible for addressing any claims by you or any third party relating to the PCC App, including: (a) product liability claims; (b) any claim that the PCC App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar laws, in each case only to the extent required by applicable law. We are also solely responsible, as between you and Apple, for the investigation, defense, settlement, and discharge of any third-party claim that the PCC App or your use of the PCC App infringes a third party’s intellectual property rights.

  1. Export and Legal Compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree not to use or export the PCC App except as authorized by U.S. law and the laws of the jurisdiction in which the PCC App was obtained.

  1. Termination

These Terms remain effective until terminated by you or us. We may suspend or terminate your access to the PCC App at any time, with or without notice, if we believe you have violated these Terms, if required by law, if a third-party service or rights holder requires it, or if the PCC App is discontinued. Upon termination, the license granted to you under these Terms will immediately terminate, and you must stop using and delete the PCC App.

  1. Changes to the PCC App or These Terms

We may modify the PCC App, discontinue any feature, or change these Terms at any time in our discretion. Updated Terms will be effective when posted or otherwise made available through the PCC App. Your continued use of the PCC App after the effective date of the revised Terms constitutes your acceptance of the revised Terms.

  1. Governing Law and Venue

These Terms shall be governed by the laws of the State of Iowa, without regard to conflict-of-laws principles, except to the extent superseded by applicable federal law or mandatory consumer protection laws. Any dispute arising out of or relating to these Terms or the PCC App shall be brought exclusively in the state or federal courts located in Polk County, Iowa, and you consent to the jurisdiction of those courts.

  1. Severability; Waiver; Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with any incorporated Privacy Policy and any applicable ticketing, onsite, or event-specific rules, constitute the entire agreement between you and us regarding the PCC App.
